SCOPE
These terms of business and use apply to the whole website northandmind.com in every language version, including the area for practitioners. They also apply to all digital products of North & Mind Studio presented on this website. The provider is North & Mind Studio, lic. phil. Jessica Yasmine Iannelli Manser (details in the imprint).
NO SALES ON THIS WEBSITE
This website is a showcase. No contracts are concluded and no payments are processed on it. Every page of a paid product links to the matching listing in the North & Mind Studio shop on Etsy. Prices, scope and availability follow the Etsy listing at the time of your order.
BUYING ON ETSY
The purchase contract is concluded on Etsy between you and North & Mind Studio. Ordering, payment and delivery of the files run through the platform of Etsy Ireland UC. Etsy's terms of use and our shop policies, which you can read on Etsy, also apply.
DIGITAL PRODUCTS AND DELIVERY
All products are digital files in PDF format. They are available for download on Etsy as soon as payment is confirmed. Nothing is shipped. Orders cannot be cancelled.
FREE FILES
Some files are offered by North & Mind Studio free of charge, directly on this website. No sign-up is needed and no contract is concluded via Etsy. The rights of use for personal products apply to free files.
WITHDRAWAL AND RETURNS
For digital content made available immediately after purchase, any statutory right of withdrawal, where one exists, ends once you have agreed to immediate delivery and the download has started. Return and exchange conditions are stated with each item on Etsy. Mandatory statutory rights remain unaffected, in particular if a file is faulty or will not open. In that case please contact us through Etsy and we will sort it out.
RIGHTS OF USE FOR PERSONAL PRODUCTS
With your purchase you receive a simple, non-transferable right to print the files for your own private use as often as you like. You may not alter the files, pass them on, resell them, publish them in whole or in part, or use them commercially.
RIGHTS OF USE FOR MATERIAL FOR PRACTITIONERS
Material for practitioners is sold with a practice licence. One person may print it without limit in their own work and hand it to their own clients, pupils or participants. The sheets may not be altered: no shortening, no redesigning, no logo of your own, no copying them into your own materials. Passing the files on to other practitioners, reselling them, publishing them online or in course material for third parties and removing the copyright notice are also not permitted. This applies to a whole set just as to every single sheet. Licences for teams and institutions are available on request.
COPYRIGHT
Texts, illustrations, layouts, the logo and all files on this website and in the products are protected by copyright. Any use beyond the rights set out here requires our prior written consent.
HEALTH NOTICE
The products are psychology-based aids for self-care and everyday life. They do not replace diagnosis, advice or treatment by a medical or psychotherapeutic professional. Details are in the disclaimer.
LIABILITY
We are liable only for damage we cause intentionally or through gross negligence. Liability for slight negligence is excluded to the extent the law permits. Liability for injury to life, body or health, and any liability that cannot be limited by law, remains unaffected. The providers of linked websites, such as Etsy or WhatsApp, are responsible for their content.
DATA PROTECTION
How this website handles data is described in the privacy policy.
APPLICABLE LAW AND JURISDICTION
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another country, the mandatory consumer protection rules of your country of residence continue to apply. Where the law allows, the place of jurisdiction is the provider's registered location.
CHANGES
We may amend these terms. A purchase is governed by the version in force when the order was placed.
